What Alabama law says about kratom

Alabama took a direct controlled-substance approach rather than regulating kratom as an adult-use botanical product. In 2016, the Legislature passed Senate Bill 226 as Act 2016-279. The Legislature's official summary states that the act added mitragynine and hydroxymitragynine, commonly known as kratom, to Schedule I. The act became effective May 10, 2016.

The distinction matters. Some states leave botanical kratom available while regulating age, labeling, testing, or the amount of particular alkaloids in a finished product. Alabama instead schedules the named alkaloids themselves. Ordinary kratom leaf naturally contains mitragynine and a smaller amount of 7-hydroxymitragynine, so the statewide rule is not limited to one package style or one concentrated format.

The Alabama Administrative Code's controlled-substance appendix continues to identify mitragynine and hydroxymitragynine within the state's Schedule I framework. That is the controlling statewide fact for shoppers, retailers, and online sellers. It is also why a marketplace listing that appears reachable from Alabama should not be treated as proof that an order is lawful or that the seller will complete shipment.

This history separates Alabama from states that later adopted Kratom Consumer Protection Acts. A consumer-protection act generally allows qualifying products to remain on the market while setting standards. Alabama's 2016 action created a statewide prohibition through controlled-substance scheduling instead.

Past legislative proposals and public debate do not change the current rule unless a later measure is enacted and becomes effective. Enacted law and official state materials are the appropriate baseline rather than advocacy maps, old retailer pages, or proposed bills.

What the statewide rule means for different kratom formats

The scheduled substances occur in the plant and are not confined to a single commercial format. The statewide restriction therefore affects the familiar forms in which kratom is sold:

• Leaf powder: ground Mitragyna speciosa leaf contains mitragynine and is not available for Alabama delivery.
• Capsules: placing leaf powder into capsules does not change the underlying alkaloid status.

Why federal status does not change the Alabama answer

Kratom is not scheduled under the federal Controlled Substances Act, but that does not prevent a state from adopting its own controlled-substance rule. Alabama used its state authority to schedule the two named alkaloids. A federal marketplace, interstate carrier, or out-of-state seller cannot erase the destination state's rule.

The most reliable signals would be a signed act, updated Alabama Code or administrative schedule, and a stated effective date.
