What Colorado law says about kratom

Colorado regulates kratom through three current statutes. Colorado Revised Statutes section 6-1-740 contains the most detailed product, package, and sales standards. Section 18-13-132 establishes the minimum age and photographic-identification requirement. Section 44-1-105 preserves the earlier statewide baseline for adulteration, labels, sales to people under 21, and retail access.

Under section 18-13-132, a person may not give, sell, distribute, dispense, or offer a kratom product for sale to anyone under 21. Before furnishing or offering a kratom product to an individual, the seller must request and examine government-issued photographic identification establishing that the individual is at least 21. The law therefore requires more than a customer simply checking a box or entering a birth date.

A violation of the underage-sales rule or the identification requirement is a civil infraction carrying a $200 fine. The statute also provides an affirmative defense to an underage-furnishing allegation when the seller was presented with and reasonably relied on government-issued photographic identification showing that the recipient was 21 or older.

Colorado also defines which products may participate in the lawful market. Section 6-1-740 describes a kratom product as a food or dietary supplement containing kratom leaf, kratom leaf extract, a kratom alkaloid, a kratom constituent, or a kratom metabolite. The definition excludes synthesized and semi-synthesized alkaloids. A product containing those ingredients does not become compliant merely because its package uses the word kratom.

A person may not knowingly prepare, distribute, advertise, sell, or offer a kratom product that is adulterated with fentanyl, another controlled substance, a synthesized or semi-synthesized alkaloid, or another substance prohibited by law. The same section prohibits a product containing more than two percent 7-hydroxymitragynine in the product's alkaloid fraction, measured as a percentage of its alkaloid composition.

The two-percent rule is not two percent of the total package weight. It applies to the proportion of 7-hydroxymitragynine within the alkaloid composition. A total-weight statement or a general ingredient percentage is therefore not a substitute for the specific alkaloid-fraction calculation required by Colorado law.

Colorado's required retail-package information

Each retail package must clearly and conspicuously display the name and business address of the manufacturer or distributor and a complete ingredient list. It must advise against use by people under 21 and by people who are pregnant or breastfeeding. It must direct consumers to consult a health-care professional before use and disclose that kratom may be habit-forming and may interact with medications, drugs, and controlled substances.

The package must also carry the statutory federal-style disclaimer and a statement directing that the product be kept out of children's reach. Directions must identify the recommended amount per serving, the number of recommended servings in the package, the recommended maximum number of servings in a 24-hour period, and the quantitative amounts of mitragynine and 7-hydroxymitragynine per serving.

Preparing, distributing, advertising, selling, or offering a noncompliant product is a deceptive trade practice under section 6-1-740. Colorado's framework therefore regulates both the physical product and the commercial conduct used to place it in the market.

How Colorado's kratom framework developed

• May 26, 2022Colorado approved SB22-120, creating sections 44-1-105 and 18-13-132 and establishing the statewide 21-plus and photographic-ID framework.
• August 10, 2022SB22-120 took effect, while its principal product protections in section 44-1-105 were scheduled to become operative later.
• July 1, 2024The adulteration, baseline label, under-21 sales, and retail-access protections in section 44-1-105 became operative.
• May 29, 2025SB25-072, the Daniel Bregger Act, became effective for conduct on or after that date and added section 6-1-740.
• July 21, 2026The 21-plus regulated-market framework remains the current statewide position.

SB25-072 substantially expanded the earlier framework. It added the present rules for synthesized and semi-synthesized alkaloids, the two-percent 7-hydroxymitragynine ceiling, candy-like and child-appealing products, combustible and vaporization formats, package disclosures, serving directions, and quantitative alkaloid declarations.

The current result is not an unrestricted market. Colorado permits qualifying products for properly verified adults, with violations handled through both the kratom-specific civil-infraction provision and the Colorado Consumer Protection Act's deceptive-trade-practice framework.

Powder, capsules, extracts, tablets, and other formats

Traditional dried leaf, powder, capsules, liquid preparations, extract powders, and tablets can potentially qualify for Colorado sale when they meet every applicable rule. Format alone never settles the question. A capsule containing a prohibited synthesized alkaloid remains prohibited, and an otherwise ordinary extract exceeding the 7-hydroxymitragynine limit remains prohibited.

• Leaf powder and capsules: potentially eligible when the contents, customer age, and retail label comply.
• Botanical extracts and MIT formats: potentially eligible when they contain no synthesized or semi-synthesized alkaloids, remain within the 7-hydroxymitragynine limit, and carry the required quantitative declarations.
• Confections and candy imitations: prohibited, including products presented in a way that appeals to children.
• Combustible and vaporization products: prohibited under section 6-1-740.
• Synthesized or semi-synthesized alkaloid products: prohibited from manufacture, packaging, labeling, distribution, sale, or offer within the regulated kratom category.

Standard powder and capsules are not exempt from the package rules. Every retail package offered to a Colorado customer must provide the required business identity, ingredients, warnings, directions, serving information, and per-serving alkaloid amounts.

Kratom shipping to Colorado from Las Vegas

This is an estimate rather than a delivery guarantee; weekends, holidays, weather, address corrections, and carrier conditions can affect arrival.

Remote fulfillment must account for section 18-13-132. The seller must request and examine government-issued photographic identification establishing that the individual is at least 21. The statute does not name a particular electronic verification company or require a specific carrier's adult-signature product, but those omissions do not remove the seller's identification duty.

Before fulfillment, the order should be matched to the verified adult purchaser and checked for prohibited alkaloids, the two-percent 7-hydroxymitragynine limit, prohibited formats, and complete retail-package information. The item shipped should be the same formulation and package reviewed for compliance.

Colorado's cited statewide kratom sections do not establish a separate kratom carrier permit. Responsibility still attaches to the sale, offer, and distribution that occur before delivery. Reliable age-verification and product records support a consistent statewide fulfillment decision.
