Is Kratom Legal in Michigan? State Law and Shipping Guide

Michigan statewide kratom status

Michigan's Public Health Code contains the state controlled-substance schedules. Sections 333.7212, 333.7214, 333.7216, 333.7218, and 333.7220 set out the substances included in Schedules 1 through 5. The schedules identify controlled substances by name, category, chemical description, and cross-reference. The current statutory schedules do not identify kratom, the Mitragyna speciosa plant, mitragynine, or 7-hydroxymitragynine as listed controlled substances.

Michigan law also gives the Department of Licensing and Regulatory Affairs administrator a process for placing a substance into a schedule under the Public Health Code. That authority does not itself make a substance scheduled. The current schedule text and any effective rule are what determine the legal classification. No official Michigan source reviewed for July 22, 2026 identifies an effective statewide rule adding kratom or its named alkaloids to a controlled-substance schedule.

The Michigan Department of Health and Human Services has separately stated in its 2026 public materials that kratom is unregulated in Michigan. The agency's Kratom 101 flyer says Michigan does not currently have a statewide age restriction. That official description is consistent with the absence of an enacted Michigan Kratom Consumer Protection Act, statewide kratom-specific product standard, or statewide kratom-only age threshold in the sources reviewed.

Michigan's statewide status is open, but it is not a state certification of every product carrying a kratom label. The legal conclusion concerns statewide scheduling and the absence of a kratom-specific prohibition or age requirement. An item's actual ingredients, product identity, and representations still matter. A product that contains a substance independently controlled under Michigan law cannot be treated as lawful merely because it is also described as kratom.

Unregulated does not mean classified as a controlled substance

The word unregulated can be misunderstood. In the Michigan Department of Health and Human Services materials, it describes the lack of a statewide kratom-specific regulatory framework and statewide age restriction. It does not convert kratom into a scheduled drug, and it does not create a Michigan statutory approval category for every product formulation.

Michigan's controlled-substance schedules remain the key legal reference for a statewide possession and classification question. The absence of kratom, mitragynine, and 7-hydroxymitragynine from those schedules supports the present statewide legal status. Separate general laws can still apply to product safety, commerce, labeling, and deceptive practices. Those laws should not be overstated as a Michigan Kratom Consumer Protection Act when no such enacted statewide act is currently in force.

The state agency's 2026 materials distinguish traditional kratom leaf products from products marketed with higher-concentration or added alkaloid content. That distinction is useful for accurately identifying an item, but the documents do not establish a new statewide kratom schedule, percentage cap, or purchase age. Statewide status should be evaluated from the enacted schedules and effective law, not from a product's marketing term alone.

Michigan legislative history

• November 2018: Senate Bill 1236 was introduced as a proposed Michigan Kratom Consumer Protection Act to regulate preparation, distribution, and sale of kratom products.
• 2019-2020 session: The 2018 proposal did not become an enacted public act, so it did not create a statewide kratom framework.
• September 2021: Senate Bill 547 was introduced with another proposed kratom product-regulation model, including labels, composition limits, and age language.
• 2021-2022 session: The proposed 2021 framework did not become an enacted Michigan public act.
• March 2026: Michigan Department of Health and Human Services public materials described kratom products as unregulated in Michigan and stated that no statewide age restriction currently exists.
• July 22, 2026: Michigan's current controlled-substance schedules continue to omit kratom, mitragynine, and 7-hydroxymitragynine.

Michigan has considered a consumer-protection approach more than once. Senate Bill 1236 in 2018 and Senate Bill 547 in 2021 proposed rules for kratom products. Proposed text may be useful for understanding what lawmakers considered, but an introduced bill does not change statewide law. Neither proposed framework appears in the current Michigan Compiled Laws as an enacted statewide kratom act.

This history matters because it prevents two opposite errors. It would be incorrect to say that Michigan enacted a Kratom Consumer Protection Act based on a bill proposal. It would also be incorrect to say that a proposal's product standards, age language, or labeling provisions are already Michigan law when the Legislature did not enact that proposal. The official agency's 2026 description confirms that the market remains unregulated at the statewide level.

Legislative status can change in a later session. A future bill could establish a minimum age, require labels, limit particular formulations, create testing requirements, or change controlled-substance scheduling. Until such a measure completes the legislative process and becomes effective, the current schedules and existing statutes remain the governing statewide references.

Powder, capsules, extracts, tablets, and bulk formats

Michigan's current statewide statutes do not make ordinary kratom legal or illegal solely by package form. The controlled-substance schedules do not create separate statewide categories for leaf powder, capsules, tablets, teas, concentrated products, gummies, or bulk orders. Michigan Department of Health and Human Services materials identify several formats found in the state, including powders, capsules, concentrated extracts, teas, drinks, gummies, and candies, while also describing the market as unregulated.

• Whole leaf and loose powder: not separately prohibited statewide merely because the product contains ordinary kratom leaf in those formats.
• Capsules: the capsule format does not itself add kratom to Michigan's controlled-substance schedules.
• Tablets and measured servings: physical form alone does not establish a statewide kratom ban or age rule.
• Botanical extracts: Michigan has no enacted statewide kratom-specific extract framework identified in the reviewed official materials; exact composition should be accurately identified.
• Concentrated or enhanced products: product names do not create a special legal category by themselves, but a seller should accurately identify the actual ingredients and avoid treating a general kratom label as proof of composition.
• Bulk formats: larger quantity does not independently change Michigan's current statewide kratom status.

Unregulated status is not a reason to be casual about product identity. The product delivered should match the description and package. A single-ingredient powder should be identified as such. A capsule, tablet, beverage, or other multi-ingredient item should accurately reflect the formulation. A product containing an independently scheduled drug is subject to the law governing that substance regardless of other branding.

No current Michigan statute identified in the official materials creates a statewide kratom-specific percentage limit for 7-hydroxymitragynine, mandates a prescribed label, or assigns different statewide legality to a product based only on its format. Those absent rules should not be invented from earlier bills. At the same time, absence of a kratom-specific standard is not a claim that every product quality, ingredient statement, or formulation is acceptable under all other applicable law.

Kratom shipping to Michigan from Las Vegas
