Is Kratom Legal in Oregon? State Law and Shipping Guide

Oregon statewide kratom law

Oregon's current statewide rules are in ORS 475.392 through 475.404, known as the Oregon Kratom Consumer Protection Act. The statute does not create a statewide ban on the defined kratom-product category. Instead, it establishes a processor-registration requirement, a 21-and-over retail restriction, and Department of Revenue authority to administer the program. The state law applies statewide; this status describes state law only.

ORS 475.394 supplies the key definitions. A processor is a person who sells, distributes, or exposes kratom products for sale on a wholesale basis to a retailer. A retailer is a person who sells, distributes, or exposes kratom products for sale to people for personal consumption. The distinction matters because Oregon places the registration duty on processors while the retail age restriction applies directly to retailers. A business can have more than one role in a supply chain, so compliance is based on what that business does with the product, not only on its label in ordinary conversation.

ORS 475.396 provides that a processor may not sell, distribute, or expose a kratom product for sale before registering with the Department of Revenue. The statute permits a civil penalty of up to $500 for a first violation and up to $1,000 for a second or later violation. Under ORS 475.404, the Department adopts registration rules, requires annual registration, and requires a processor to certify that the kratom products it will sell, distribute, or expose for sale are third-party tested to satisfy industry standards for adulteration. The Department's current registration page states that registration is required for sales occurring after July 1, 2023.

The adult-age rule is direct. ORS 475.398 prohibits a retailer from selling, distributing, or exposing a kratom product for sale to an individual under 21 years of age. Each violation is a Class C misdemeanor. Oregon's law describes the retail transaction and does not make the age rule optional because an order is handled online or delivered by carrier. Kratom Paradise treats Oregon orders as 21-and-over transactions and limits shipments to products that fit the statewide framework.

The statute does not prescribe a single package design, a statewide consumer registration, a named carrier, or an adult-signature method. It does establish the registration-and-age baseline for the defined product category. The Department's registration material also says that a registrant must certify third-party testing and retain relevant batch test results. Those are processor obligations, while the age limit remains a retail rule. Both are part of the statewide legal treatment of an Oregon kratom sale.

Oregon legal history

Oregon's present framework came from House Bill 4010 in the 2022 regular session. The Oregon Legislative Information System identifies HB 4010 as Chapter 41 and summarizes it as a measure requiring processor registration, directing Department of Revenue rulemaking, authorizing civil penalties, and creating the under-21 retail restriction. The provisions are now codified as ORS 475.392 through 475.404.

The history is important because an earlier 2021 Oregon measure, HB 2646, appears in legislative records as vetoed. It is not the enacted source of the current statewide framework. The active law is the later 2022 enactment, HB 4010, Chapter 41. The distinction avoids attributing provisions from a vetoed proposal to current Oregon law.

The enacted 2022 statute placed the program with the Department of Revenue. Oregon's Department of Revenue now maintains a Kratom Processor Registration page, identifies HB 4010 as the source of the program, and lists a dedicated Kratom Registration contact. The agency's materials state that registration is annual and that its rules permit batch testing of unfinished or finished kratom products for contaminants. The state legal history is therefore an enacted, administered consumer-protection program rather than a statewide prohibition.

The law was enacted into statute using ORS section numbers, with a statutory note that the sections were enacted by the Legislative Assembly but not added to or made part of ORS chapter 475 by legislative action. That publication note does not remove the requirements. The current Oregon Revised Statutes page gives the operative text and the Department's program page describes the active registration procedure.

Oregon format implications

Oregon's definition is broad enough to cover a food, food product, food ingredient, dietary ingredient, dietary supplement, or beverage for human consumption containing any part of the Mitragyna speciosa leaf. The Department's registration page distinguishes an unfinished kratom product from a finished kratom product. It describes unfinished product as plant material intended for consumer sale in its original state and gives an extract as an example of a finished product made by combining or altering unfinished material into a final consumer form.

• Leaf powder: Traditional leaf powder can fall within the statutory definition when it contains part of the leaf and is handled through the required processor-registration framework.
• Capsules: Capsules can fit the law's food or dietary-supplement product categories when the product contains the defined plant material and is supplied through a registered processor.
• Botanical extracts: The Department identifies an extract as an example of a finished kratom product. Extract format does not remove the registration and adult-age rules.
• Beverage or tea formats: The statutory definition expressly includes a beverage for human consumption containing part of the leaf. The same statewide processor and retail-age rules apply.
• Bulk leaf packaging: Package size does not change the product definition or the registration requirement. Bulk leaf powder must still be supplied within Oregon's processor framework.
• Products outside the definition: The Act speaks to products containing part of the Mitragyna speciosa leaf. A name alone does not establish that a product is inside Oregon's defined kratom-product category.

Oregon does not list a separate statewide menu of approved retail formats in ORS 475.392 through 475.404. The legal questions are whether the item falls within the statutory definition, whether its processor is registered, and whether the retail sale is to a person at least 21. The Department's testing-certification requirement is directed to the processor. A retailer's or customer's preferred format does not override those statewide conditions.

Kratom Paradise's Oregon treatment follows those distinctions. Eligible traditional leaf powder, capsules, and qualifying botanical extract formats may be shipped to Oregon when the product is within the statewide framework and the purchaser meets the age requirement. A product is not treated as Oregon-eligible merely because its package uses a kratom-related name. Product contents, the statutory definition, and supply-chain compliance remain relevant.

Kratom shipping to Oregon

Kratom Paradise currently ships eligible traditional kratom products to Oregon addresses for customers age 21 and older. Oregon is a western destination from Las Vegas, so the estimated delivery window is 1 business day after carrier acceptance. The estimate is not a delivery guarantee. Carrier processing, order timing, weekends, holidays, weather, address corrections, and service interruptions can change actual arrival.

Oregon's retail age rule applies even where a shipment is placed online and delivered elsewhere in the state. Orders are screened for Oregon eligibility before fulfillment. Kratom Paradise does not treat online ordering as an exception to ORS 475.398, and it does not treat a processor-registration issue as a purely administrative matter that can be ignored for a customer shipment.

The state statute does not require a particular carrier or establish a statewide delivery-day promise. The 1-business-day figure is Kratom Paradise's current western-state estimate after the carrier accepts the package. It is a transit estimate, not a promise that every Oregon address will receive an order the next calendar day. Fulfillment time occurs before carrier acceptance.

Oregon shipping remains limited to eligible formats and lawful adult transactions. Traditional product forms may be shippable when they meet the state definition and supply-chain conditions. Orders involving a purchaser who does not meet the 21-and-over rule, or a product that is not handled within the statewide framework, are not treated as Oregon-eligible shipments.
