Is Kratom Legal in Pennsylvania? State Law and Shipping Guide

The current statewide answer is that Pennsylvania has no statewide kratom prohibition identified in the enacted materials reviewed and no enacted statewide Kratom Consumer Protection Act. The Pennsylvania Controlled Substance, Drug, Device and Cosmetic Act is the Commonwealth's principal statute for controlled-substance schedules. The statute establishes schedules and gives the Secretary authority to control substances through the state process. Kratom is not listed by name in the statute's schedules as reviewed, and the Pennsylvania Department of Education's 2025 traffic-patrol training manual expressly states that kratom is not controlled under the Controlled Substance Act.

That status should be read precisely. It means there is no enacted statewide kratom-specific ban or dedicated statewide kratom sales framework identified as of the review date. The official Pennsylvania General Assembly record, generated July 22, 2026, lists the last action as referral to the Senate Health and Human Services Committee on February 4, 2025. The page lists no votes, no committee meetings, and no statute references. That history means the proposal is not an enacted statewide rule on the review date.

Pennsylvania's current statewide legal record has two relevant layers.
